Terms of use for visitors to the Davidson Institute of Science Education website

Welcome to the Website of the Davidson Institute of Science education (hereinafter, "the Website" and "the Institute" respectively). The Website is managed and operated by the Institute and includes much information from a variety of fields, including links to Websites under the auspices of the Institute and the Weizmann Institute of Science. By logging in and using the Website, you confirm that you have read and understand the Terms of Use of the Website, which constitute an agreement between you and the Institute ("Terms of Use"), that you agree to these terms and agree to abide by the instructions here within, and that you and any person or body acting on your behalf are obliged by these terms and that you and any person or body acting on your behalf shall have no claim and/or suit and/or demand against the Institute and/or person or body acting on its behalf as long as the Institute has not violated the Terms of Use. If you do not agree to the Terms of Use, you are requested to leave the Website and not use it and/or its services.
1. General
1.1 Use of this Website is subject to the Terms of Use and their application. Therefore, you are requested to read the Terms of Use carefully and abide by them.
1.2. The information and the Content on the Website are provided "as is", and you shall not have any allegation or claim against the Institute and/or person or body acting on its behalf for any aspects, limitations and/or existing options of the Website, or its suitability to your needs or requirements.
1.3. The Terms of Use on the Davidson Online Website are listed in section 4 below. These terms shall apply in addition to the terms in this document, except in the case of contradiction, in which case the Terms of Use in this document that refer to Davidson online will prevail against the terms of section 4.
2. Proper use of the Website
2.1. You agree to conduct yourself responsibly when using the Website and to behave respectfully towards other visitors of the Website, Website managers, and any other party whose interests may be harmed as a result of your use of the Website.
2.2. Use of the Website is for lawful purposes only. If the Institute discovers and/or suspects that you are not conducting proper usage of the Website, it may, at its sole discretion, immediately and without notice terminate your use of any or part of the services offered on the Website.
3. Limited use/restrictions concerning copyright and intellectual property
3.1. Terms of Use apply to use of the Website and Contents included therein. The term "Content" or "Contents" includes, but is not limited to, databases, graphic design, information of any kind, including stories, articles, reviews, data, information, Content, analysis, evaluations, in the following formats: text, images, video, computer software, computer reserve, and/or voice, that are available to users on the Website, and any other detail relating to the operation of the Website.
3.2. Copyright and intellectual property contained in the Website Content and services, as well as the names and trademarks are the property of the Institute and/or of third parties, from whom the Institute has received a legal license of use, unless explicitly stated otherwise.
3.3. If you believe that the Website and/or the Contents violate any copyrights that you own, please notify us as soon as possible. Use of the Content is restricted for personal use and for press use only (all forms of media, including social media) and the Contents, or part of them, may not be used for any commercial use or otherwise contrary to the Terms of Use, including:
3.3.1. Creating a link to the Website or to any Website that contains Content which is harmful;
3.3.2. Infiltrating into the material and/or to tampering with computer files and/or transferring a computer virus to other computers and/or using or tampering with other computers in violation of the amendments Law 1995.
3.3.3. Posting any Content that damages or that, according to the Institute, may damage the reputation of the Institute, its employees and or parties acting on its behalf and/or third parties and/or that violates copyright of the Institute, its employees and/or parties acting on its behalf and/or of third parties and/or that violates any other right of the Institute, its employees and/or parties acting on its behalf and/or third parties.
4. Davidson online
Without diminishing from the above mentioned in this document, the terms of use of Davidson online will be as follows:
4.1 Written materials - Terms of Use of written materials only (not including pictures, videos and applets) will be the terms of use of the license relating to this document (Creative Commons). These materials may be used 'as-is', without editing or making any changes to these materials and clear credit should be given to the Institute for every use of these materials.
4.2 Pictures - terms of use of pictures and images will be as follows:
4.2.1 Pictures that are not marked as being original and belong to Creative Commons can be used 'as-is'. It is prohibited to edit the picture or change it in any way and credit must be given to the Institute clearly each and every time that the picture is used.
4.2.2 It is prohibited to use and to copy pictures from the Shutterstock website, whose copyright belongs to the Shutterstock website. These pictures also include Thumbnail images (a small version of the image that helps to identify the main image and its topic), unless it is noted otherwise under the thumbnail in which case it should be stated clearly that the pictures are from the Shutterstock website.
4.3. Video clips
4.3.1. The terms of use of embedded video clips on the website from the YouTube website - will be according to the license conditions shown on the YouTube website itself (creative commons or standard YouTube license) which can be accessed by clicking on the YouTube link with the caption 'YouTube' that is displayed under every video clip.
4.3.2. For the terms of use of embedded video clips from other websites, each video clip should be checked individually according to the link that appears under the clip or on the clip itself and the website from where the video was taken should be checked to determine the relevant terms of use for the video clip.
4.4. Applets (small applications - computerized games, computerized images) – the terms of use of applets will be as follows:
4.4.1. Applets of the PhET project – in accordance with the terms of use of the website from where the applet was taken – usually according to Creative Commons which can be seen by clicking on the link that clarifies the terns of the license.
4.4.2. Other applets - each applet should be checked individually according to the link that appears under the applet or on the applet itself and the website from where the applet was taken should be checked to determine the relevant terms of use for the applet.
5. Use of the website
5.1. The services on the Website are for personal use only. You are not allowed to make any use of the Website for any commercial activity, unless you have received the prior written express consent of the Institute. You hereby undertake not to use the Website and/or its Content for any illegal purposes or for any purpose prohibited pursuant to these Terms of Use. The Institute reserves its right, without being obligated to do so:
5.1.1. To edit and/or remove any information from the Website that, according to the Institute's sole discretion is in breach of these Terms of Use;
5.1.2. To take any actions against users who, according to the Institute’s sole discretion, are in breach of the Terms of Use and/or use or have used the Website in a prohibited manner, including termination of the provision of services, blocking access to the Website and/or taking any legal proceedings.
5.2. The Institute shall not bear any liability for any damage that you might incur as a result of any wrongful use of the Website. You bear the full and sole liability for any such prohibited use made by you, and you hereby undertake to indemnify the Institute in respect of any damage incurred as a consequence thereof.
6.Services requiring registration
6.1. Some of the services on the Website require registration, and you might be required to provide personal information in order to register. If you do not provide the requested information, which is required to complete registration, you will be unable to register for these services. By registering, you give consent for the information you provide to be retained and used by the Institute, subject to any applicable law. You may be required to select a username and password when registering for a service, which will identify you when accessing the service. It is your responsibility to safeguard your username and password in order to prevent misuse thereof. The Institute, at its absolute discretion, may decide not to allow you to use a service that requires registration.
6.2.The Institute is entitled to block your access to a service requiring registration. Without diminishing from the above mentioned, the Institute may cancel your registration for a service, or block your access to such a service, at its sole discretion.
7. The Website’s Contents
7.1. Linked content and users' content - The Website displays links to content on other websites, as well as content originating from users of the Website. The Institute has no control over the content on other websites and/or over content being published by the Institute’s users, and the Institute is not being represented in any way by these websites.
7.2. You hereby agree that, upon accessing any other website, you shall be subject to the terms of use and policies of the website, and the responsibility to abide by such terms of use applies solely to you. It is hereby clarified that the mere existence of a link to a website or the posting of content by a user does not infer sponsorship and/or that the Institute is advocating and/or agreeing with any fact stated therein. The Institute does not guarantee that all links on the Website will function properly and lead to an active website. The mere existence of a link on the Website to any other website does not infer that the content of the linked website is reliable, complete or up-to-date.
7.3. The Website might offer a search engine that shall enable you to locate information and content published on the Internet in general and on the Website in particular. A portion of the information and content referred to above is not published by the Institute or on its behalf, and the Institute is not able to control or supervise the content of such material.
8. Limits of liability and indemnity
8.1. Without diminishing from that stated in these Terms of Use, it is hereby clarified that, as a fundamental condition to this agreement, you expressly agree that the usage of the Website is your personal responsibility only.
8.2. The Institute does not guarantee that your access and/or use of the Website will be provided regularly, securely and without any delay and/or failure and/or error and/or disruption in performance, or that any particular result will be obtained from use of the Website.
8.3. The services on the Website are provided “as is,” without any liability, whether overt and/or implied, except for liability that cannot be limited by law, but only to the extent such law applies to these Terms of Use or to a liability that the Institute has expressly assumed.
8.4. The Institute shall not be liable towards you for any damage, whether direct and/or indirect and/or incidental and/or special and/or consequential; furthermore, the Institute shall not be held liable in respect of any loss, whether direct or indirect, that might be caused to a user and/or to any third party, in relation to any matter pertaining to and concerning the Website and/or the services, to the cancellation thereof, the restriction thereof or the discontinuance thereof.
8.5. The Institute is not responsible or liable for any content that might be uploaded to the Website by its users, and any such uploading of information, including content that, by its very uploading, suffices to infringe upon the rights of third parties, shall be at the sole responsibility and liability of the user.
8.6. The Website may offer software programs that may be downloaded to your personal computer and/or links to websites enabling you to download such software programs. Unless otherwise stated explicitly, the Institute does not develop or test the quality of such software programs, and offering a link to them does not attest to their reliability and/or compatibility with your needs and/or your computer. The downloading of such software programs to your computer shall be entirely and solely your own responsibility, and the use thereof is subject to the licensing conditions included in such programs.
8.7. You hereby undertake to indemnify the Institute, its employees, managers or any party acting on its behalf, in respect of any damage, loss, loss of profit, payment or expense that might be caused due to a breach of these Terms of Use. You shall also be obligated to indemnify the above-mentioned parties in respect of any allegation, claim and/or demand that might be raised against them by any third party as a result of content that you furnished for publication on the Website, and as a result of links you created at the Website.
9. Changes on the Website and discontinuance of the service
9.1. The Institute is entitled to change the structure, appearance and design of the Website from time to time, as well as the volume and availability of the services therein, at its sole discretion. Naturally, changes of this type are liable to involve disruptions and/or give rise to inconvenience. You shall not have any allegation, claim and/or demand against the Institute in respect of the implementation of such changes and/or in respect of disruptions that might occur due to the implementation of such changes.
9.2. The Institute may disconnect, restrict or discontinue the services on the Website at any time, including, but not limited, for the purpose of performing essential or immediate maintenance and/or set-up operations on systems serving the Website.
9.3. Without diminishing from that stated above, the Institute may discontinue the services on the Website at any time, in whole or in part. Should the Institute decide to discontinue the provision of services, notice thereof shall be announced on the home page of the Website a reasonable period of time in advance. Upon discontinuance of services, the Institute shall retain the material and Content contained on the Website for a reasonable period, and subsequently, shall be allowed to delete such material and Content without retaining any backup thereof, and without issuing any further notice in this regard.
9.4. The Institute reserves its right to amend these Terms of Use from time to time, at its sole discretion. An amendment of these Terms of Use shall be implemented by an update thereof on the Website, and such amendments shall be binding upon you as of the date of the update on the Website. Your continued use of the Website shall constitute your agreement with the amended Terms of Use.
10. Applicable law and jurisdiction
Use of the Website shall be subject solely to the laws and regulations of the State of Israel. Any issue and matter deriving from this agreement and/or relating to the Website shall be deliberated by the competent courts in Tel-Aviv – Jaffa, who shall have exclusive jurisdiction.
